Fees and Payments

Nearly everyone inquiring about a new Web site, a redesign, or other Web site needs wants to know how much services cost and when and how payments are to be made.

How much will it cost?

iComs services are competitively priced. Since every project is different, we'll need details about what you have in mind, after which we'll be happy to provide you with an estimate. See our Planning Your Web Site FAQ to see what information we'll need to provide you with an esimate.

We base our estimates and proposals on how much time it will take to complete your project, additional materials needed (such as photos), based on the details we learn from you. In addition, if you let us know your budget, we'll provide an estimate that stays within or below it. See the next question below, Can IComs work within your budget?

There are no hidden fees or surprises, as we spell everything out in our contract after we've discussed the details of your needs.

If you have a preference, we're happy to charge by the project or by time and materials for most projects.

Do you have a small project in mind, such as a few images to be optimized for the Web? We can provide estimates for that, too, of course.

Can iComs work within your budget?

Have a specific budget to meet? Most companies and individuals do, and we take a realistic approach. We're experienced with tailoring our work to provide the best results within your budget needs. Let us know your budget and we'll tailor our estimate to stay within that.

What types of payments does iComs accept?

IComs accepts payments online via PayPal or by cheque. Cheque's may be made payable to Icoms and sent to:

What is the payment schedule?

Payments are typically due in two to four parts:

A deposit and signed contract are required before beginning our work together. The deposit is usually one-third to one-half of the total amount established in the contract.

For larger projects or longer time frames, incremental payments could be due along the way, which would be defined in the contract.

Upon completion of the Web site by IComs, the final balance will be due and payable. As soon as final payment is received, the Web site files will be uploaded (via ftp) to the client's Web site.

Additional work not included in our contract will be added to the balance. Payment in full is required prior to uploading the pages to your Web site (or sending the files to you via email or postal mail).

Scheduling, Time Frames

How long will it take?

Once IComs has all your content in final form and a signed contract and deposit, a typical Web site will take about 30 days. Larger sites may take longer, and smaller sites may take less time.

Time frames spelled out

The time frames for delivery of your content to IComs and the steps along the way with the design process are written into our contract together. IComs will work with you to establish realistic dates to complete our project with you in a timely manner.

Content ready?

For Web site design and development projects, please note that it's important to have all your final version content ready to go. IComs is happy to consult with you about content that you may need, including written content, images, logos, and related information. Once IComs receives all your content in final form the Web site design and construction can begin. See also our Planning Your Web Site FAQ

If you need something in a hurry, there might be a rush fee.

How soon can we start?

IComs officially schedules projects upon receipt of the signed contract and deposit. Your content will also need to be ready to go by the dates agreed upon within our contract together.

It's common to have initial discussions about the project, work out the contract details, and schedule the project to begin a few weeks later to allow you to gather your content, images, and other materials needed. If you have all your content and materials ready now, we'll work out our schedule to get started sooner.

Perhaps you want to get started on gathering your content now, even though you may not be ready to start on the Web site project for a few months. IComs is happy to schedule the project to begin several months from now, of course, upon receipt of a signed contract and deposit.

Browsers, Standards, Accessibility, CSS, HTML, XHTML

What about the quality behind-the-scenes? What about browsers?

Can IComs create sites that will look good in any browser?

We have over 10 years of experience developing sites for a wide range of browsers, such as Internet Explorer, Opera, Netscape, Mozilla, and Safari. Our sites will also work across platforms, such as Windows PCs or Apple Macintosh computers.

We'll base the design and development on your target market while making sure your site works well and is fully accessible by even older browsers or text-only browsers or alternative devices.

Can IComs create standards-compliant sites?

Yes. IComs is an expert in creating standards-compliant Web sites, following W3C Recommendationsfor Web site markup since 1996. All the Web sites we create validate to W3C Recommendations upon completion.

Can IComs create accessible sites based on W3C's WCAG, or other accessibility requirements?

Yes. All the Web sites we create conform to WCAG (Web Content Accessibility Guidelines). Just like creating standards-based Web sites, we are experts at creating Web sites that are widely accessible and conform to W3C's WCAG.

Does IComs use style sheets, or CSS?

Yes. Style sheets provide a site's visual presentation. Their use is important for the site's development and easy visual maintenance. IComs is an expert in using CSS effectively and developing stunning Web sites with their use that are easy to maintain.

Content Updating

Keeping your content fresh and up-to-date is an important part of managing your Web site.

Can IComs update content when needed after the site design is completed?

Yes, absolutely. We appreciate ongoing relationships with our clients. For ongoing site updating we typically just bill by the hour and send invoices once or twice a month.

Can IComs create our site to manage updating ourselves?

Of course. IComs can create or redesign your site so that you can easily update content yourself, even if you don't know any HTML. If you have any questions along the way, or if you need our services for image optimization, for example, we're still more than happy to assist.

Definitions:

The Client : The company or individual requesting the services of Icoms Ltd..

Icoms Ltd.: Primary designer/site owner & employees or affiliates.

General

Icoms Ltd. will carry out work only where an agreement is provided either by email, telephone, mail or fax. Icoms Ltd. will carry out work only for clients who are 18 years of age or above. An 'order' is deemed to be a written or verbal contract between Icoms Ltd. and the client, this includes telephone and email agreements.

Website Design

Whilst every endeavor will be made to ensure that the website and any scripts or programs are free of errors, Icoms Ltd. cannot accept responsibility for any losses incurred due to malfunction, the website or any part of it.

The website, graphics and any programming code remain the property of Icoms Ltd. until all outstanding accounts are paid in full.

Any scripts, cgi applications, php scripts, or software (unless specifically agreed) written by Icoms Ltd. remain the copyright of Icoms Ltd. and may only be commercially reproduced or resold with the permission of Icoms Ltd..

Icoms Ltd. cannot take responsibility for any copyright infringements caused by materials submitted by the client. We reserve the right to refuse any material of a copyrighted nature unless adequate proof is given of permission to use such material.

Any additions to briefs provided will be carried out at the discretion of Icoms Ltd. and where no charge is made by Icoms Ltd. for such additions, Icoms Ltd. accept no responsibility to ensure such additions are error free and reserve the right to charge an according amount for any correction to these or further additions.

The client agrees to make available as soon as is reasonably possible to Icoms Ltd. all materials required to complete the site to the agreed standard and within the set deadline.

Icoms Ltd. will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed deadlines.

Icoms Ltd. will not be liable or become involved in any disputes between the site owner and their clients and cannot be held responsible for any wrongdoing on the part of a site owner. eg. Any disputes re content/images that have been provided to us for inclusion on the site.

Icoms Ltd. will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of the client or any of the clients appointed agents.

Icoms Ltd. will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of the site, its servers, software or any material provided by its agents.

A deposit of 35% is required with any standard project and 50% for database driven projects before any design work will be carried out. This figure may be higher for websites of an adult nature and is non-refundable.

Once a website has been designed and completed the final balance of payment is then due in accordance with our payment terms. There are no exceptions to this, i.e If the client decides they no longer want the site, as they have commissioned the work and paid a deposit they are still obliged to pay for the work that has been done. Non payment will result in legal action being taken if necessary. Once full payment is received for a website, it is assumed that the project has been completed to the clients satisfaction and no refunds can be offered. We do offer free updates for a month after completion to allow for any final amendments that may be required.

Database, Application and E-Commerce Development

Icoms Ltd. cannot take responsibility for any losses incurred by the use of any software created for the client. Whilst every care has been taken to ensure products are problem free and accurate, the ultimate responsibility lies with the client in ensuring that all software is functioning correctly before use.

Any scripts, applications or software (unless specifically agreed) written by Icoms Ltd. remain the copyright of Icoms Ltd. and may only be commercially reproduced or resold with the permission of Icoms Ltd..

Where applications or sites are developed on servers not recommended by Icoms Ltd., the client is expected to provide or seek any information,additional software,support or co-operation pertaining to the server required in order for the application to be correctly developed. Where large applications are to be developed, it is the clients responsibility to provide a suitable testing environment which is identical to the final production environment.

The client is expected to test fully any application or programming relating to a site developed by Icoms Ltd. before being made generally available for use. Where "bugs", errors or other issues are found after the site is live, Icoms Ltd. will endeavor (but is not obliged to) to correct these issues to meet the standards of function outlined in the brief

Compatibility

Icoms Ltd. will endeavor to ensure that any developed/designed site or application will function correctly on the server it is initially installed in and that it will function correctly when viewed with the web browsing software Microsoft Internet Explorer Version 6 and to an acceptable level with Mozilla browsers. Icoms Ltd. can offer no guarantees of correct function with all browser software.

Website Hosting

Whilst Icoms Ltd. recommends hosting companies to host websites, no guarantees can be made as to the availability or interruption of this service by Icoms Ltd. cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

Icoms Ltd. reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial, and also to terminate the free hosting service should the necessity arise.

Website Optimization

Due to external factors, such as changes to the way search engines rank websites, we cannot offer any guarantees regarding the position we will achieve for websites. The process of optimizing websites itself will bring in more traffic and hits and you'll see visits increase to your site naturally. We cannot accept liablility for any change in rankings, or drop off in the position of your website due to changes in the algorithms of the search engines or the factors that they use to rank websites.

We use 'white hat techniques' when optimizing websites and always aim to achieve a top ten ranking for your website within six months of undertaking the optimization process. Due to the work involved payment is generally required in advance and we are unable to offer a refund of any Icoms clients in relation to this type of work.

Icoms Ltd. reserve the right to refuse to handle in any way, material which may be deemed offensive, illegal or in any way controversial.

Payment of Accounts

A deposit is required from any new client before any work is carried out. It is the Icoms Ltd. policy that any outstanding accounts for work carried out by Icoms Ltd. or its affiliates are required to be paid in full, no later than 30 days from the date of the invoice unless by prior arrangement with Icoms Ltd..

Once a deposit is paid and work completed you are obliged to pay the balance of payment in full. We will contact clients via email and telephone to remind them of such payments if they are not received when due.

If accounts are not settled or Icoms Ltd. have not been contacted regarding the delay, access to the related website may be denied and web pages removed, we will then pass such cases to the Small Claims Court to pursue payment, non payment can result in county court judgements (ccj's) being added to the clients credit rating.

Following consistent non payment of an invoice our Solicitors will contact the client in question, with a view to taking the matter further and if need be to seek payment through legal procedures, and if necessary court summons.

Complaints Procedure

Informal procedure

Anyone who experiences a problem with their web service provided by Icoms Ltd. should raise the matter directly using our online contact form to do so, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint.

Icoms Ltd. will approach the individual responsible for the material in question with a view to resolving the matter to the satisfaction of the complainant.

Formal complaints procedure

The formal complaints procedure should only be used where the complainant feels that the nature of the complaint is too serious to be dealt with informally, or where a satisfactory conclusion has not been reached after following the informal procedure.

A formal complaint should be made in writing to Icoms Ltd., who will acknowledge receipt and ensure that the matter is looked into as soon as possible.

An initial response to any complaint can be expected within seven days of its receipt; a full and considered response to the complaint should be completed within 30 days and any subsequent remedy implemented with the minimum of delay.
